Federal Firearms Investigations

Firearms crimes are codified in both federal and state law. Federal investigations into firearms crimes are usually conducted by The Bureau of Alcohol, Tobacco, Firearms and Explosives (“ATF”) and The Federal Bureau of Investigations (“FBI”). Walker & Taylor, PLLC, has experienced attorneys who can assist in investigations relating to:

Interstate Trafficking of Firearms

Unlawful Possession of a National Firearms Act Item, Such as an Unregistered Machine Gun or Suppressor

Unlicensed Importation of Defense Articles or Implements of War

Straw Purchases

Unlawful Possession of a Short-Barreled Rifle or Short-Barreled Shotgun

Willful Violation of Firearm Dealer Administrative Regulations (FFLs and SOTs)

Material Misrepresentation on Form 4473

Engaging in the Business of Buying, Selling, or Transporting Firearms Without a License

Legal Authority:

Many of the criminal acts related to firearms are contained in Title 18, Chapter 44 of the United States Code. Specifically, Section 922 contains the unlawful acts related to firearm transactions and possession. In addition, the Code of Federal Regulations Parts 447, 478 and 479 provide administrative regulations relating to firearm dealers and transactions. Finally, on the state level, Texas Penal Code Chapter 46 prohibits certain conduct relating to firearms.

If you have been contacted by the ATF, FBI, or local law enforcement, having an attorney on your side can be critical.

Please contact Walker & Taylor if you would like to schedule a case evaluation.
